Of course, the best way to recover from a bad surgery is to not have a bad surgery in the first place. After a physician has injured a patient, the injured patient naturally wants to be made whole. One way for a patient to be made whole is to sue the offending physician. Suing physicians — even if they’re guilty — is difficult, no matter what state you’re in, but Alabama is the most difficult state for patients to sue physicians. Because it is so difficult to sue physicians in Alabama, many frustrated patients can do no more than to leave a quack physician a bad review on Google or Yelp.

One reason why it is so difficult to sue physicians in Alabama is that, unless a lawyer has a case that involves death or paralysis, he or she is unlikely to deem the case worthwhile, because a law firm has to expend a lot of resources (money and manhours) to pursue a medical malpractice claim, and medical malpractice judgments for cases that do not involve death or paralysis are simply not high enough to warrant a law firm spending its valuable resources. It’s an unfortunate reality that most victims of quackery are left with no recourse for their suffering.

Aside from the expense pursuing a medical malpractice claim, in some states (such as Alabama), a physician’s past malpractice lawsuits — even if the physician was judged guilty of malpractice — cannot be used against him or her in a current malpractice case. That means that past incidents of a physician’s quackery are not admissible as evidence that a physician is guilty medical malpractice in any future cases. By filing a class action lawsuit against a physician, all allegations — within the class — of quackery can be used against the physician. Additionally, many of the costs of pursuing a medical malpractice case can be shared among members of a class. For example, if 6 former patients decide to sue a physician, then those 6 patients can all share the cost of hiring a medical expert to testify against the doctor, they can also share the cost of man manhours of legal work. Class action medical malpractice lawsuits give many victimized patients an avenue to pursue justice that they had previously thought to be unattainable.
